1. Introduction and Acceptance

Welcome to AnswerClinic ("we," "our," or "the Company"). These Terms of Service ("Terms") govern your access to and use of:

  • The AnswerClinic website (www.answerclinic.com or equivalent).
  • The AnswerClinic mobile application ("the App").
  • All related medical management services and features (collectively, the "Services").

By accessing or using the Services, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must immediately cease using the Services.

2. Intended Audience: Healthcare Professionals Only

IMPORTANT:

The AnswerClinic App is currently designed and intended exclusively for use by healthcare providers, doctors, medical staff, and authorized administrative personnel ("Providers" or "Users").

  • Not for Direct Patient Use: The App is not currently open for the general public or patients to create accounts directly.
  • Verification: You represent and warrant that you are a qualified healthcare professional or an authorized employee of a healthcare entity. We reserve the right to verify your credentials (e.g., medical license number) at any time.

3. Medical Disclaimer

AnswerClinic is a Technology Platform, Not a Healthcare Provider.

  • No Medical Advice: We provide the software for you to manage your practice and patients. We do not practice medicine, diagnose patients, or prescribe treatments.
  • Professional Judgment: You, as the Provider, are solely responsible for all medical decisions, diagnoses, and treatments rendered to your patients. You agree that your use of the App does not substitute your professional judgment.
  • No Emergency Use: The Services should not be relied upon for critical emergency situations where technology failure could lead to harm.

4. Data Privacy and Patient Consent

Your use of the Service involves processing sensitive health information ("Protected Health Information" or PHI).

  • Your Responsibility: You represent and warrant that you have obtained all necessary patient consents and authorizations required by law (including HIPAA in the U.S.) to upload, store, and process patient data within AnswerClinic.
  • Privacy Policy: Our handling of this data is governed by our Privacy Policy, which explains how we secure data using encryption and services like AWS S3 and Firebase.

5. User Accounts and Security

  • Credentials: You are responsible for maintaining the confidentiality of your login credentials. Given the sensitive nature of the data (medical records), you must notify us immediately of any unauthorized access.
  • Staff Access: If you grant access to your staff (e.g., nurses, assistants), you are responsible for their adherence to these Terms.

6. Acceptable Use and Permissions

To use the App, you may need to grant permissions for:

  • Microphone/Camera: To facilitate teleconsultations or upload medical documents/photos.
  • Location: For geolocation of services via Google Maps.
  • Notifications: For reminders and updates.

You agree NOT to:

  • Use the Service for any illegal purpose.
  • Upload false, misleading, or infringing content.
  • Attempt to reverse engineer the App or compromise our security.

7. Payments and Billing

  • Certain features of the Service may be subject to fees.
  • Payment Processing: We use Stripe as our secure payment gateway. AnswerClinic does not store full credit card details.
  • Refunds: Refund policies are subject to the specific service agreement signed between AnswerClinic and the medical practice.

8. Intellectual Property

The AnswerClinic brand, logo, code, and design are the exclusive property of the AnswerClinic development team. You are granted a limited, non-exclusive, non-transferable license to use the Service for your professional practice.

9. Limitation of Liability

To the fullest extent permitted by law:

  • AnswerClinic provides the Service "AS IS" and "AS AVAILABLE."
  • We are not liable for any malpractice, negligence, or clinical errors committed by Users of the App.
  • We are not liable for service interruptions due to third-party providers (e.g., Twilio, AWS, Google).

10. Termination

We reserve the right to suspend or terminate your account if:

  • You violate these Terms.
  • Your medical license is revoked or suspended.
  • You request deletion of your account via info@answerclinic.com.

11. Governing Law

These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved in the courts of Miami, Florida.
